Friday Five Focus on Regulation – 5 Questions in 5 Minutes Every Friday

What’s this all about?

Each week, we ask questions relating to one of these topics: Investments, Taxation, Pensions, Protection, or Regulation. This week, our Friday Five is relevant to Regulation; this is useful as you prepare for either of the CII’s R01 or CF1 exams. The challenge is for you to answer them in 5 minutes. Answers at the bottom of the page.

Questions

IMPORTANT! These questions relate to examinable tax year 2025/26, examinable by the CII until 31 August 2026. They do not relate to tax year 2026/27 which is only examinable by the CII from 1 September 2026.

  1. The difference in legal status between an independent financial adviser (IFA) and a representative of a product provider is that a provider’s representative
    1. is the agent of the provider whereas an IFA is the agent of the client.
    2. can only be self-employed whereas an IFA can be a sole trader, partnership, or limited company.
    3. can only offer advice in one product area, whereas an IFA can offer advice from across the financial services spectrum.
    4. acts as an introducer only whereas an IFA is authorised to advise.

  1. Which of these is an example of a ‘required function’ under the Senior Managers and Certification Regime senior management functions?

Answers

  1. A; See R01 Study Text, Chp 8; Rationale: Legally, an IFA is the agent of the client, whilst a representative of a provider is the agent of the provider. A representative of a provider can be employed by the provider and can offer advice (not just act as an introducer) across all the provider’s products, not just one product area. They are restricted to offering advice on products from the single provider they are representing.
  2. B; See R01 Study Text, Chp 6; Rationale: The answer is Markets in Financial Instruments Directive (MiFID). MiFID is an EU-led regulation designed to increase competition and investor protection and bring harmonisation across the EU states. COBS are the updated (as of 1st Nov 2007) FCA’s conduct of business requirements for investment firms, which incorporated the MiFID requirements.
  3. D; See R01 Study Text, Chp 7; Rationale: Sale and rent-back schemes are home finance activities, rather than activities of an investment intermediary.
  4. C; See R01 Study Text, Chp 6; Rationale: All authorised firms must disclose their regulatory status to clients. This must be included on all letters or electronic equivalents such as email and fax. Best practice encourages this on business cards and compliment slips also, but it is not required on text messages.
  5. C; See R01 Study Text, Chp 7; Rationale: There are three main types of senior management functions (SMFs) under SM&CR: governing functions, required functions and systems and controls functions. Of the options listed in our question, only compliance oversight is an example of a required function. The others are examples of governing or systems and controls functions.
